Read All Ahadith In The Book Of muslim

It was narrated from Ash-Sha'bi, from Fatimah bint Qais, that concerning a woman who has been thrice divorced, the Prophet (s.a.w) said: "She is not entitled to accommodation nor maintenance."

حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى وَابْنُ بَشَّارٍ قَالاَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِىٍّ حَدَّثَنَا سُفْيَانُ عَنْ سَلَمَةَ بْنِ كُهَيْلٍ عَنِ الشَّعْبِىِّ عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ عَنِ النَّبِىِّ -صلى الله عليه وسلم- فِى الْمُطَلَّقَةِ ثَلاَثًا قَالَ « لَيْسَ لَهَا سُكْنَى وَلاَ نَفَقَةٌ ».

It was narrated that Abu Ishaq said: "I was with Al-Aswad bin Yazid, sitting in the grand Masjid, and Ash-Sha'bi was with us. Ash-Sha'bi narrated the Hadith of Fatimah bint Qais, that the Messenger of Allah (s.a.w) did not grant to her any accommodation nor maintenance. Then Al-Aswad took a handful of pebbles and threw them at him, and said: 'Woe to you for narrating such a thing. 'Umar said: We will not leave the Book of Allah and the Sunnah of our Prophet (s.a.w) for the words of a woman when we do not know whether she remembered or forgot. She is entitled to accommodation and maintenance. And he recited the verse: "...And turn them not out of their (husband's) homes nor shall they (themselves) leave, except in case they are guilty of some open Fahishah...'"

وَحَدَّثَنَاهُ مُحَمَّدُ بْنُ عَمْرِو بْنِ جَبَلَةَ حَدَّثَنَا أَبُو أَحْمَدَ حَدَّثَنَا عَمَّارُ بْنُ رُزَيْقٍ عَنْ أَبِى إِسْحَاقَ قَالَ كُنْتُ مَعَ الأَسْوَدِ بْنِ يَزِيدَ جَالِسًا فِى الْمَسْجِدِ الأَعْظَمِ وَمَعَنَا الشَّعْبِىُّ فَحَدَّثَ الشَّعْبِىُّ بِحَدِيثِ فَاطِمَةَ بِنْتِ قَيْسٍ أَنَّ رَسُولَ اللَّهِ -صلى الله عليه وسلم- لَمْ يَجْعَلْ لَهَا سُكْنَى وَلاَ نَفَقَةً ثُمَّ أَخَذَ الأَسْوَدُ كَفًّا مِنْ حَصًى فَحَصَبَهُ بِهِ. فَقَالَ وَيْلَكَ تُحَدِّثُ بِمِثْلِ هَذَا قَالَ عُمَرُ لاَ نَتْرُكُ كِتَابَ اللَّهِ وَسُنَّةَ نَبِيِّنَا -صلى الله عليه وسلم- لِقَوْلِ امْرَأَةٍ لاَ نَدْرِى لَعَلَّهَا حَفِظَتْ أَوْ نَسِيَتْ لَهَا السُّكْنَى وَالنَّفَقَةُ قَالَ اللَّهُ عَزَّ وَجَلَّ (لاَ تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ وَلاَ يَخْرُجْنَ إِلاَّ أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ ).

It was narrated that Abu Bakr bin Abi Al-Jahm bin Sukhair Al-'Adawi said: "I heard Fatimah bint Qais say that her husband divorced her thrice, and the Messenger of Allah (s.a.w) did not grant her any accommodation or maintenance. She said: 'The Messenger of Allah (s.a.w) said to me: "When your 'Iddah is over, let me know." So she let him know, and Mu'awiyah, Abu Jahm and Usamah bin Zaid proposed to her. The Messenger of Allah (s.a.w) said: "As for Mu'awiyah, he is a poor man who has no wealth. As for Abu Jahm, he is a man who beats women. But (choose) Usamah bin Zaid." She gestured with her hand like this, (as if expressing disapproval), saying said: "Usamah!? Usamah!?" But the Messenger of Allah (s.a.w) said to her: "Obedience to Allah and obedience to His Messenger is better for you." She said: 'So I married him and I was envied."'

وَحَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِى شَيْبَةَ حَدَّثَنَا وَكِيعٌ حَدَّثَنَا سُفْيَانُ عَنْ أَبِى بَكْرِ بْنِ أَبِى الْجَهْمِ بْنِ صُخَيْرٍ الْعَدَوِىِّ قَالَ سَمِعْتُ فَاطِمَةَ بِنْتَ قَيْسٍ تَقُولُ إِنَّ زَوْجَهَا طَلَّقَهَا ثَلاَثًا فَلَمْ يَجْعَلْ لَهَا رَسُولُ اللَّهِ -صلى الله عليه وسلم- سُكْنَى وَلاَ نَفَقَةً قَالَتْ قَالَ لِى رَسُولُ اللَّهِ -صلى الله عليه وسلم- « إِذَا حَلَلْتِ فَآذِنِينِى ».فَآذَنْتُهُ فَخَطَبَهَا مُعَاوِيَةُ وَأَبُو جَهْمٍ وَأُسَامَةُ بْنُ زَيْدٍ. فَقَالَ رَسُولُ اللَّهِ -صلى الله عليه وسلم- « أَمَّا مُعَاوِيَةُ فَرَجُلٌ تَرِبٌ لاَ مَالَ لَهُ وَأَمَّا أَبُو جَهْمٍ فَرَجُلٌ ضَرَّابٌ لِلنِّسَاءِ وَلَكِنْ أُسَامَةُ بْنُ زَيْدٍ ». فَقَالَتْ بِيَدِهَا هَكَذَا أُسَامَةُ أُسَامَةُ فَقَالَ لَهَا رَسُولُ اللَّهِ -صلى الله عليه وسلم- « طَاعَةُ اللَّهِ وَطَاعَةُ رَسُولِهِ خَيْرٌ لَكِ ». قَالَتْ فَتَزَوَّجْتُهُ فَاغْتَبَطْتُ.

It was narrated that Abu Bakr bin Abi Al-Jahm said: "I heard Fatimah bint Qais say: 'My husband Abu 'Amr bin Hafs bin Al-Mughirah sent 'Ayyash bin Abi Rabi'ah to me with word of my divorce, and he sent with him five Sa's of dates and five Sa's of barley. I said: "Do I get no maintenance other than this? And am I not to observe my 'Iddah in your home?" He said: "No." She said: "I got dressed and went to the Messenger of Allah (s.a.w). He said: 'How many times has he divorced you?' I said: 'Three.' He said: 'He is right, you are not entitled to maintenance. Observe your 'Iddah in the house of your cousin 'Amr bin Umm Maktum, for he is blind and you can take off your garments there. When your 'Iddah is over, let me know.' Some men proposed to me, including Mu'awiyah and Abu Al-Jahm. The Prophet (s.a.w) said to me: 'Mu'awiyah is poor and destitute, and Abu Al-Jahm is harsh towards women' - or 'he beats women,' or words to that effect - 'but you should marry Usamah bin Zaid."'

وَحَدَّثَنِى إِسْحَاقُ بْنُ مَنْصُورٍ حَدَّثَنَا عَبْدُ الرَّحْمَنِ عَنْ سُفْيَانَ عَنْ أَبِى بَكْرِ بْنِ أَبِى الْجَهْمِ قَالَ سَمِعْتُ فَاطِمَةَ بِنْتَ قَيْسٍ تَقُولُ أَرْسَلَ إِلَىَّ زَوْجِى أَبُو عَمْرِو بْنُ حَفْصِ بْنِ الْمُغِيرَةِ عَيَّاشَ بْنَ أَبِى رَبِيعَةَ بِطَلاَقِى وَأَرْسَلَ مَعَهُ بِخَمْسَةِ آصُعِ تَمْرٍ وَخَمْسَةِ آصُعِ شَعِيرٍ فَقُلْتُ أَمَا لِى نَفَقَةٌ إِلاَّ هَذَا وَلاَ أَعْتَدُّ فِى مَنْزِلِكُمْ قَالَ لاَ. قَالَتْ فَشَدَدْتُ عَلَىَّ ثِيَابِى وَأَتَيْتُ رَسُولَ اللَّهِ -صلى الله عليه وسلم- فَقَالَ « كَمْ طَلَّقَكِ ». قُلْتُ ثَلاَثًا. قَالَ « صَدَقَ لَيْسَ لَكِ نَفَقَةٌ. اعْتَدِّى فِى بَيْتِ ابْنِ عَمِّكِ ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ ضَرِيرُ الْبَصَرِ تُلْقِى ثَوْبَكِ عِنْدَهُ فَإِذَا انْقَضَتْ عِدَّتُكِ فَآذِنِينِى ». قَالَتْ فَخَطَبَنِى خُطَّابٌ مِنْهُمْ مُعَاوِيَةُ وَأَبُو الْجَهْمِ. فَقَالَ النَّبِىُّ -صلى الله عليه وسلم- « إِنَّ مُعَاوِيَةَ تَرِبٌ خَفِيفُ الْحَالِ وَأَبُو الْجَهْمِ مِنْهُ شِدَّةٌ عَلَى النِّسَاءِ - أَوْ يَضْرِبُ النِّسَاءَ أَوْ نَحْوَ هَذَا - وَلَكِنْ عَلَيْكِ بِأُسَامَةَ بْنِ زَيْدٍ ».

Abu Bakr bin Abi Al-Jahm said: "Abu Salamah bin 'Abdur-Rahman and I entered upon Fatimah bint Qais. We asked her and she said: 'I was married to Abu 'Amr bin Hafs bin Al-Mughirah. He went out on the campaign to Najran..."' and he quoted a Hadith like that of Ibn Mahdi (no . 3713), and added: "She said: 'So I married him and Allah honored me with Abu Zaid and Allah blessed me with Abu Zaid."'

وَحَدَّثَنِى إِسْحَاقُ بْنُ مَنْصُورٍ أَخْبَرَنَا أَبُو عَاصِمٍ حَدَّثَنَا سُفْيَانُ الثَّوْرِىُّ حَدَّثَنِى أَبُو بَكْرِ بْنُ أَبِى الْجَهْمِ قَالَ دَخَلْتُ أَنَا وَأَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمَنِ عَلَى فَاطِمَةَ بِنْتِ قَيْسٍ فَسَأَلْنَاهَا فَقَالَتْ كُنْتُ عِنْدَ أَبِى عَمْرِو بْنِ حَفْصِ بْنِ الْمُغِيرَةِ فَخَرَجَ فِى غَزْوَةِ نَجْرَانَ. وَسَاقَ الْحَدِيثَ بِنَحْوِ حَدِيثِ ابْنِ مَهْدِىٍّ وَزَادَ قَالَتْ فَتَزَوَّجْتُهُ فَشَرَّفَنِى اللَّهُ بِابْنِ زَيْدٍ وَكَرَّمَنِى اللَّهُ بِابْنِ زَيْدٍ.

It was narrated from Hisham: "My father told me: 'Yahya bin Sa'eed bin Al-'As married the daughter of 'Abdur-Rahman bin Al-Hakam, then he divorced her and expelled her out of his house. 'Urwah criticized them for that, and they said: "Fatimah went out (of her husband's house)." 'Urwah said: "I went to 'Aishah and told her about that. She said: 'There is nothing good for Fatimah bint Qais in narrating this Hadith."'

وَحَدَّثَنَا أَبُو كُرَيْبٍ حَدَّثَنَا أَبُو أُسَامَةَ عَنْ هِشَامٍ حَدَّثَنِى أَبِى قَالَ تَزَوَّجَ يَحْيَى بْنُ سَعِيدِ بْنِ الْعَاصِ بِنْتَ عَبْدِ الرَّحْمَنِ بْنِ الْحَكَمِ فَطَلَّقَهَا فَأَخْرَجَهَا مِنْ عِنْدِهِ فَعَابَ ذَلِكَ عَلَيْهِمْ عُرْوَةُ فَقَالُوا إِنَّ فَاطِمَةَ قَدْ خَرَجَتْ. قَالَ عُرْوَةُ فَأَتَيْتُ عَائِشَةَ فَأَخْبَرْتُهَا بِذَلِكَ فَقَالَتْ مَا لِفَاطِمَةَ بِنْتِ قَيْسٍ خَيْرٌ فِى أَنْ تَذْكُرَ هَذَا الْحَدِيثَ.

It was narrated that Fatimah bint Qais said: "I said: 'O Messenger of Allah, my husband has divorced me three times, and I am afraid that someone may break in.' So he told her to move.''

وَحَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى حَدَّثَنَا حَفْصُ بْنُ غِيَاثٍ حَدَّثَنَا هِشَامٌ عَنْ أَبِيهِ عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ قَالَتْ قُلْتُ يَا رَسُولَ اللَّهِ زَوْجِى طَلَّقَنِى ثَلاَثًا وَأَخَافُ أَنْ يُقْتَحَمَ عَلَىَّ. قَالَ فَأَمَرَهَا فَتَحَوَّلَتْ.

It was narrated from 'Abdur-Rahman bin Al-Qasim that his father said: "'Urwah bin Az-Zubair said to 'Aishah: 'Do you not see so-and-so the daughter of Al-Hakam? Her husband divorced her three times and she left.' She said: 'It is a bad thing that she has done.' He said: 'Have you not heard what Fatimah says?' She said: 'There is nothing good for her in mentioning that."'

وَحَدَّثَنِى إِسْحَاقُ بْنُ مَنْصُورٍ أَخْبَرَنَا عَبْدُ الرَّحْمَنِ عَنْ سُفْيَانَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ عَنْ أَبِيهِ قَالَ قَالَ عُرْوَةُ بْنُ الزُّبَيْرِ لِعَائِشَةَ أَلَمْ تَرَىْ إِلَى فُلاَنَةَ بِنْتِ الْحَكَمِ طَلَّقَهَا زَوْجُهَا الْبَتَّةَ فَخَرَجَتْ فَقَالَتْ بِئْسَمَا صَنَعَتْ. فَقَالَ أَلَمْ تَسْمَعِى إِلَى قَوْلِ فَاطِمَةَ فَقَالَتْ أَمَا إِنَّهُ لاَ خَيْرَ لَهَا فِى ذِكْرِ ذَلِكَ.

Jabir bin 'Abdullah said: "My maternal aunt was divorced and she wanted to harvest her date palms. A man rebuked her for going out, so she went to the Prophet (s.a.w) (inquiring about going out during 'Iddah) and he said: 'No, go and harvest your date palms, for perhaps you will give charity or do an act of kindness."'

وَحَدَّثَنِى مُحَمَّدُ بْنُ حَاتِمِ بْنِ مَيْمُونٍ حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ عَنِ ابْنِ جُرَيْجٍ ح وَحَدَّثَنَا مُحَمَّدُ بْنُ رَافِعٍ حَدَّثَنَا عَبْدُ الرَّزَّاقِ أَخْبَرَنَا ابْنُ جُرَيْجٍ ح وَحَدَّثَنِى هَارُونُ بْنُ عَبْدِ اللَّهِ - وَاللَّفْظُ لَهُ - حَدَّثَنَا حَجَّاجُ بْنُ مُحَمَّدٍ قَالَ قَالَ ابْنُ جُرَيْجٍ أَخْبَرَنِى أَبُو الزُّبَيْرِ أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ يَقُولُ طُلِّقَتْ خَالَتِى فَأَرَادَتْ أَنْ تَجُدَّ نَخْلَهَا فَزَجَرَهَا رَجُلٌ أَنْ تَخْرُجَ فَأَتَتِ النَّبِىَّ -صلى الله عليه وسلم- فَقَالَ « بَلَى فَجُدِّى نَخْلَكِ فَإِنَّكِ عَسَى أَنْ تَصَدَّقِى أَوْ تَفْعَلِى مَعْرُوفًا ».

'Ubaidullah bin 'Abdullah bin 'Utbah bin Mas'ud narrated that his father wrote to 'Umar bin 'Abdullah bin Al-Arqam Az-Zuhri, telling him to go to Subai'ah bint Al-Harith Al-Aslamiyyah to ask her about her Hadith, and what the Messenger of Allah (s.a.w) said to her when she consulted him. 'Umar bin 'Abdullah wrote back to 'Abdullah bin 'Utbah telling him that Subai'ah told him that she was married to Sa'd bin Khawlah, one of Banu 'Amir bin Lu'ayy, who was one of those who had been present at (the Battle of) Badr. He died during the Farewell Pilgrimage while she was pregnant, and she gave birth shortly after he died. When her Nifas ended, she adorned herself to receive offers of marriage. Abu As-Sanabil bin Ba'kak - a man from Banu 'Abd Ad-Dar - entered upon her and said to her: "Why do I see you beautified? Perhaps you are hoping to get married? By Allah, you will not get married until four months and ten days have passed!" Subai'ah said: "When he said that to me, I got dressed that evening and went to the Messenger of Allah (s.a.w) and asked him about that. He advised me that my 'Iddah had ended when I gave birth, and he told me to get married if I wanted to." Ibn Shihab said: "I do not see anything wrong with (a woman) getting married after she has given birth, even if she is still bleeding, but her husband should not come close to her until she becomes pure."

وَحَدَّثَنِى أَبُو الطَّاهِرِ وَحَرْمَلَةُ بْنُ يَحْيَى - وَتَقَارَبَا فِى اللَّفْظِ - قَالَ حَرْمَلَةُ حَدَّثَنَا وَقَالَ أَبُو الطَّاهِرِ أَخْبَرَنَا ابْنُ وَهْبٍ - حَدَّثَنِى يُونُسُ بْنُ يَزِيدَ عَنِ ابْنِ شِهَابٍ حَدَّثَنِى عُبَيْدُ اللَّهِ بْنُ عَبْدِ اللَّهِ بْنِ عُتْبَةَ بْنِ مَسْعُودٍ أَنَّ أَبَاهُ كَتَبَ إِلَى عُمَرَ بْنِ عَبْدِ اللَّهِ بْنِ الأَرْقَمِ الزُّهْرِىِّ يَأْمُرُهُ أَنْ يَدْخُلَ عَلَى سُبَيْعَةَ بِنْتِ الْحَارِثِ الأَسْلَمِيَّةِ فَيَسْأَلَهَا عَنْ حَدِيثِهَا وَعَمَّا قَالَ لَهَا رَسُولُ اللَّهِ -صلى الله عليه وسلم- حِينَ اسْتَفْتَتْهُ فَكَتَبَ عُمَرُ بْنُ عَبْدِ اللَّهِ إِلَى عَبْدِ اللَّهِ بْنِ عُتْبَةَ يُخْبِرُهُ أَنَّ سُبَيْعَةَ أَخْبَرَتْهُ أَنَّهَا كَانَتْ تَحْتَ سَعْدِ ابْنِ خَوْلَةَ وَهُوَ فِى بَنِى عَامِرِ بْنِ لُؤَىٍّ وَكَانَ مِمَّنْ شَهِدَ بَدْرًا فَتُوُفِّىَ عَنْهَا فِى حَجَّةِ الْوَدَاعِ وَهْىَ حَامِلٌ فَلَمْ تَنْشَبْ أَنْ وَضَعَتْ حَمْلَهَا بَعْدَ وَفَاتِهِ فَلَمَّا تَعَلَّتْ مِنْ نِفَاسِهَا تَجَمَّلَتْ لِلْخُطَّابِ فَدَخَلَ عَلَيْهَا أَبُو السَّنَابِلِ بْنُ بَعْكَكٍ - رَجُلٌ مِنْ بَنِى عَبْدِ الدَّارِ - فَقَالَ لَهَا مَا لِى أَرَاكِ مُتَجَمِّلَةً لَعَلَّكِ تَرْجِينَ النِّكَاحَ إِنَّكِ وَاللَّهِ مَا أَنْتِ بِنَاكِحٍ حَتَّى تَمُرَّ عَلَيْكِ أَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ. قَالَتْ سُبَيْعَةُ فَلَمَّا قَالَ لِى ذَلِكَ جَمَعْتُ عَلَىَّ ثِيَابِى حِينَ أَمْسَيْتُ فَأَتَيْتُ رَسُولَ اللَّهِ -صلى الله عليه وسلم- فَسَأَلْتُهُ عَنْ ذَلِكَ فَأَفْتَانِى بِأَنِّى قَدْ حَلَلْتُ حِينَ وَضَعْتُ حَمْلِى وَأَمَرَنِى بِالتَّزَوُّجِ إِنْ بَدَا لِى. قَالَ ابْنُ شِهَابٍ فَلاَ أَرَى بَأْسًا أَنْ تَتَزَوَّجَ حِينَ وَضَعَتْ وَإِنْ كَانَتْ فِى دَمِهَا غَيْرَ أَنْ لاَ يَقْرَبُهَا زَوْجُهَا حَتَّى تَطْهُرَ.
