It was narrated from Zaid bin Thabit that the Messenger of Allah (s.a.w) granted a concession with regard to 'Araya, allowing it to be sold for a similar measure.

وَحَدَّثَنَا ابْنُ نُمَيْرٍ حَدَّثَنَا أَبِى حَدَّثَنَا عُبَيْدُ اللَّهِ حَدَّثَنِى نَافِعٌ عَنِ ابْنِ عُمَرَ عَنْ زَيْدِ بْنِ ثَابِتٍ أَنَّ رَسُولَ اللَّهِ -صلى الله عليه وسلم- رَخَّصَ فِى الْعَرَايَا أَنْ تُبَاعَ بِخَرْصِهَا كَيْلاً.

It was narrated from Bushair bin Yasar from some of the Companions of the Messenger of Allah (s.a.w) who were members of his family, including Sahl bin Abi Hathmah, that the Messenger of Allah (s.a.w) forbade selling fresh dates for dried dates. He said: "That is Riba, that is Muzabanah." But he granted a concession allowing the sale of 'Ariyyah, where the produce of one or two palm trees is assigned to a household in return for an estimated measure of dried dates, so that they can eat fresh dates.

وَحَدَّثَنَا عَبْدُ اللَّهِ بْنُ مَسْلَمَةَ الْقَعْنَبِىُّ حَدَّثَنَا سُلَيْمَانُ - يَعْنِى ابْنَ بِلاَلٍ - عَنْ يَحْيَى - وَهُوَ ابْنُ سَعِيدٍ - عَنْ بُشَيْرِ بْنِ يَسَارٍ عَنْ بَعْضِ أَصْحَابِ رَسُولِ اللَّهِ -صلى الله عليه وسلم- مِنْ أَهْلِ دَارِهِمْ مِنْهُمْ سَهْلُ بْنُ أَبِى حَثْمَةَ أَنَّ رَسُولَ اللَّهِ -صلى الله عليه وسلم- نَهَى عَنْ بَيْعِ الثَّمَرِ بِالتَّمْرِ وَقَالَ « ذَلِكَ الرِّبَا تِلْكَ الْمُزَابَنَةُ ». إِلاَّ أَنَّهُ رَخَّصَ فِى بَيْعِ الْعَرِيَّةِ النَّخْلَةِ وَالنَّخْلَتَيْنِ يَأْخُذُهَا أَهْلُ الْبَيْتِ بِخَرْصِهَا تَمْرًا يَأْكُلُونَهَا رُطَبًا.

Rafi' bin Khadij and Sahl bin Abi Hathmah narrated that the Messenger of Allah (s.a.w) forbade Muzabanah, selling fresh dates for dried dates, except for those who owned 'Araya - he gave them permission.

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِى شَيْبَةَ وَحَسَنٌ الْحُلْوَانِىُّ قَالاَ حَدَّثَنَا أَبُو أُسَامَةَ عَنِ الْوَلِيدِ بْنِ كَثِيرٍ حَدَّثَنِى بُشَيْرُ بْنُ يَسَارٍ مَوْلَى بَنِى حَارِثَةَ أَنَّ رَافِعَ بْنَ خَدِيجٍ وَسَهْلَ بْنَ أَبِى حَثْمَةَ حَدَّثَاهُ أَنَّ رَسُولَ اللَّهِ -صلى الله عليه وسلم- نَهَى عَنِ الْمُزَابَنَةِ الثَّمَرِ بِالتَّمْرِ إِلاَّ أَصْحَابَ الْعَرَايَا فَإِنَّهُ قَدْ أَذِنَ لَهُمْ.

It was narrated from Ibn 'Umar that the Messenger of Allah (s.a.w) forbade Muzabanah. Muzabanah refers to selling fresh dates for dried dates by measure, and selling grapes for raisins by measure.

حَدَّثَنَا يَحْيَى بْنُ يَحْيَى التَّمِيمِىُّ قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّ رَسُولَ اللَّهِ -صلى الله عليه وسلم- نَهَى عَنِ الْمُزَابَنَةِ وَالْمُزَابَنَةُ بَيْعُ الثَّمَرِ بِالتَّمْرِ كَيْلاً وَبَيْعُ الْكَرْمِ بِالزَّبِيبِ كَيْلاً.

It was narrated from Nafi' that 'Abdullah told him that the Prophet (s.a.w) forbade Muzabanah. Muzabanah means selling the produce of palm trees for dried dates by measure, or selling grapes for raisins by measure, or selling crops for dried wheat by measure.

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِى شَيْبَةَ وَمُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ نُمَيْرٍ قَالاَ حَدَّثَنَا مُحَمَّدُ بْنُ بِشْرٍ حَدَّثَنَا عُبَيْدُ اللَّهِ عَنْ نَافِعٍ أَنَّ عَبْدَ اللَّهِ أَخْبَرَهُ أَنَّ النَّبِىَّ -صلى الله عليه وسلم- نَهَى عَنِ الْمُزَابَنَةِ بَيْعِ ثَمَرِ النَّخْلِ بِالتَّمْرِ كَيْلاً وَبَيْعِ الْعِنَبِ بِالزَّبِيبِ كَيْلاً وَبَيْعِ الزَّرْعِ بِالْحِنْطَةِ كَيْلاً.

It was narrated that Ibn 'Umar said: "The Messenger of Allah (s.a.w) forbade Muzabanah. Muzabanah means selling the produce of palm trees for dried dates by measure, or selling grapes for raisins by measure, or selling any kind of produce for an estimated measure of the same kind of produce."

حَدَّثَنِى يَحْيَى بْنُ مَعِينٍ وَهَارُونُ بْنُ عَبْدِ اللَّهِ وَحُسَيْنُ بْنُ عِيسَى قَالُوا حَدَّثَنَا أَبُو أُسَامَةَ حَدَّثَنَا عُبَيْدُ اللَّهِ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ قَالَ نَهَى رَسُولُ اللَّهِ -صلى الله عليه وسلم- عَنِ الْمُزَابَنَةِ وَالْمُزَابَنَةُ بَيْعُ ثَمَرِ النَّخْلِ بِالتَّمْرِ كَيْلاً وَبَيْعُ الزَّبِيبِ بِالْعِنَبِ كَيْلاً وَعَنْ كُلِّ ثَمَرٍ بِخَرْصِهِ.

It was narrated from Ibn 'Umar that the Messenger of Allah (s.a.w) forbade Muzabanah. Muzabanah means selling what is up on the palm trees for dried dates of a specified amount (by saying), "If there is more it is mine and if there is less then I owe you."

حَدَّثَنِى عَلِىُّ بْنُ حُجْرٍ السَّعْدِىُّ وَزُهَيْرُ بْنُ حَرْبٍ قَالاَ حَدَّثَنَا إِسْمَاعِيلُ - وَهُوَ ابْنُ إِبْرَاهِيمَ - عَنْ أَيُّوبَ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّ رَسُولَ اللَّهِ -صلى الله عليه وسلم- نَهَى عَنِ الْمُزَابَنَةِ وَالْمُزَابَنَةُ أَنْ يُبَاعَ مَا فِى رُءُوسِ النَّخْلِ بِتَمْرٍ بِكَيْلٍ مُسَمًّى إِنْ زَادَ فَلِى وَإِنْ نَقَصَ فَعَلَىَّ.

It was narrated that 'Abdullah said: "The Messenger of Allah (s.a.w) forbade Muzabanah, selling the produce of one's garden. If it is palm trees; for dried dates by measure, and if it is grapes; selling them for raisins by measure, and if it is unharvested produce; selling it for a measure of harvested produce. He forbade all of that."

حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ حَدَّثَنَا لَيْثٌ ح وَحَدَّثَنِى مُحَمَّدُ بْنُ رُمْحٍ أَخْبَرَنَا اللَّيْثُ عَنْ نَافِعٍ عَنْ عَبْدِ اللَّهِ قَالَ نَهَى رَسُولُ اللَّهِ -صلى الله عليه وسلم- عَنِ الْمُزَابَنَةِ أَنْ يَبِيعَ ثَمَرَ حَائِطِهِ إِنْ كَانَتْ نَخْلاً بِتَمْرٍ كَيْلاً وَإِنْ كَانَ كَرْمًا أَنْ يَبِيعَهُ بِزَبِيبٍ كَيْلاً وَإِنْ كَانَ زَرْعًا أَنْ يَبِيعَهُ بِكَيْلِ طَعَامٍ. نَهَى عَنْ ذَلِكَ كُلِّهِ. وَفِى رِوَايَةِ قُتَيْبَةَ أَوْ كَانَ زَرْعًا.

It was narrated from Ibn 'Umar that the Messenger of Allah (s.a.w) said: "Whoever sells date palms that have been pollinated, the produce belongs to the seller, unless the buyer stipulates otherwise."

حَدَّثَنَا يَحْيَى بْنُ يَحْيَى قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّ رَسُولَ اللَّهِ -صلى الله عليه وسلم- قَالَ « مَنْ بَاعَ نَخْلاً قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْبَائِعِ إِلاَّ أَنْ يَشْتَرِطَ الْمُبْتَاعُ ».

It was narrated that 'Abdullah bin 'Umar said: "I heard the Messenger of Allah (s.a.w) say: 'Whoever buys palm trees after they have been pollinated, their produce belongs to the seller, unless the buyer stipulates otherwise. Whoever buys a slave, his property belongs to the one who sold him, unless the buyer stipulated otherwise.'"

حَدَّثَنَا يَحْيَى بْنُ يَحْيَى وَمُحَمَّدُ بْنُ رُمْحٍ قَالاَ أَخْبَرَنَا اللَّيْثُ ح وَحَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ حَدَّثَنَا لَيْثٌ عَنِ ابْنِ شِهَابٍ عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ بْنِ عُمَرَ عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ قَالَ سَمِعْتُ رَسُولَ اللَّهِ -صلى الله عليه وسلم- يَقُولُ « مَنِ ابْتَاعَ نَخْلاً بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلَّذِى بَاعَهَا إِلاَّ أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنِ ابْتَاعَ عَبْدًا فَمَالُهُ لِلَّذِى بَاعَهُ إِلاَّ أَنْ يَشْتَرِطَ الْمُبْتَاعُ ».
