It was narrated that Jabir said: "We used to rent (Khabir) land at the time of the Messenger of Allah (s.a.w) and we would get a share of the grain left in the ears after threshing and of such-and-such (a quantity). Then the Messenger of Allah (s.a.w) said: 'Whoever has land (surplus) let him cultivate it or let his brother till it, otherwise, let him leave it."'

حَدَّثَنَا أَحْمَدُ بْنُ يُونُسَ حَدَّثَنَا زُهَيْرٌ حَدَّثَنَا أَبُو الزُّبَيْرِ عَنْ جَابِرٍ قَالَ كُنَّا نُخَابِرُ عَلَى عَهْدِ رَسُولِ اللَّهِ -صلى الله عليه وسلم- فَنُصِيبُ مِنَ الْقِصْرِىِّ وَمِنْ كَذَا فَقَالَ رَسُولُ اللَّهِ -صلى الله عليه وسلم- « مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا أَوْ فَلْيُحْرِثْهَا أَخَاهُ وَإِلاَّ فَلْيَدَعْهَا ».

Jabir bin 'Abdullah said: "At the time of the Messenger of Allah (s.a.w) we used to take land in return for one-third or one-quarter of that which grew along the water channels. The Messenger of Allah (s.a.w) addressed us concerning that and said: 'Whoever has land, let him cultivate it. If he does not cultivate it, let him lend it to his brother. If he does not lend it to his brother, let him keep it."'

حَدَّثَنِى أَبُو الطَّاهِرِ وَأَحْمَدُ بْنُ عِيسَى جَمِيعًا عَنِ ابْنِ وَهْبٍ - قَالَ ابْنُ عِيسَى حَدَّثَنَا عَبْدُ اللَّهِ بْنُ وَهْبٍ - حَدَّثَنِى هِشَامُ بْنُ سَعْدٍ أَنَّ أَبَا الزُّبَيْرِ الْمَكِّىَّ حَدَّثَهُ قَالَ سَمِعْتُ جَابِرَ بْنَ عَبْدِ اللَّهِ يَقُولُ كُنَّا فِى زَمَانِ رَسُولِ اللَّهِ -صلى الله عليه وسلم- نَأْخُذُ الأَرْضَ بِالثُّلُثِ أَوِ الرُّبُعِ بِالْمَاذِيَانَاتِ فَقَامَ رَسُولُ اللَّهِ -صلى الله عليه وسلم- فِى ذَلِكَ فَقَالَ « مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا فَإِنْ لَمْ يَزْرَعْهَا فَلْيَمْنَحْهَا أَخَاهُ فَإِنْ لَمْ يَمْنَحْهَا أَخَاهُ فَلْيُمْسِكْهَا ».

It was narrated that Jabir said: "I heard the Prophet (s.a.w) say: 'Whoever has land, let him donate it or lend it."'

حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى حَدَّثَنَا يَحْيَى بْنُ حَمَّادٍ حَدَّثَنَا أَبُو عَوَانَةَ عَنْ سُلَيْمَانَ حَدَّثَنَا أَبُو سُفْيَانَ عَنْ جَابِرٍ قَالَ سَمِعْتُ النَّبِىَّ -صلى الله عليه وسلم- يَقُولُ « مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَهَبْهَا أَوْ لِيُعِرْهَا ».

It was narrated from Jabir bin 'Abdullah that the Messenger of Allah (s.a.w) forbade leasing out land. Bukhair said: "Nafi' told me that he heard Ibn 'Umar say: 'We used to lease out land, then we stopped doing that when we heard the Hadith of Rafi' bin Khadij."'

وَحَدَّثَنِى هَارُونُ بْنُ سَعِيدٍ الأَيْلِىُّ حَدَّثَنَا ابْنُ وَهْبٍ أَخْبَرَنِى عَمْرٌو - وَهُوَ ابْنُ الْحَارِثِ - أَنَّ بُكَيْرًا حَدَّثَهُ أَنَّ عَبْدَ اللَّهِ بْنَ أَبِى سَلَمَةَ حَدَّثَهُ عَنِ النُّعْمَانِ بْنِ أَبِى عَيَّاشٍ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ أَنَّ رَسُولَ اللَّهِ -صلى الله عليه وسلم- نَهَى عَنْ كِرَاءِ الأَرْضِ.قَالَ بُكَيْرٌ وَحَدَّثَنِى نَافِعٌ أَنَّهُ سَمِعَ ابْنَ عُمَرَ يَقُولُ كُنَّا نُكْرِى أَرْضَنَا ثُمَّ تَرَكْنَا ذَلِكَ حِينَ سَمِعْنَا حَدِيثَ رَافِعِ بْنِ خَدِيجٍ.

It was narrated that Jabir said: "The Messenger of Allah (s.a.w) forbade selling years ahead." According to the report of Ibn Abi Shaibah: (the Messenger of Allah (s.a.w) forbade) "Selling produce for years ahead."

وَحَدَّثَنَا سَعِيدُ بْنُ مَنْصُورٍ وَأَبُو بَكْرِ بْنُ شَيْبَةَ وَعَمْرٌو النَّاقِدُ وَزُهَيْرُ بْنُ حَرْبٍ قَالُوا حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ حُمَيْدٍ الأَعْرَجِ عَنْ سُلَيْمَانَ بْنِ عَتِيقٍ عَنْ جَابِرٍ قَالَ نَهَى النَّبِىُّ -صلى الله عليه وسلم- عَنْ بَيْعِ السِّنِينَ. وَفِى رِوَايَةِ ابْنِ أَبِى شَيْبَةَ عَنْ بَيْعِ الثَّمَرِ سِنِينَ.

It was narrated that Abu Hurairah said: "The Messenger of Allah (s.a.w) said: 'Whoever has land, let him cultivate it or lend it to his brother, and if he insists, let him keep his land."

حَدَّثَنَا حَسَنُ بْنُ عَلِىٍّ الْحُلْوَانِىُّ حَدَّثَنَا أَبُو تَوْبَةَ حَدَّثَنَا مُعَاوِيَةُ عَنْ يَحْيَى بْنِ أَبِى كَثِيرٍ عَنْ أَبِى سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ عَنْ أَبِى هُرَيْرَةَ قَالَ قَالَ رَسُولُ اللَّهِ -صلى الله عليه وسلم- « مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا أَوْ لِيَمْنَحْهَا أَخَاهُ فَإِنْ أَبَى فَلْيُمْسِكْ أَرْضَهُ ».

Abu Sa'eed Al-Khudri said: "The Messenger of Allah (s.a.w) forbade Muzabanah and Muhaqalah. Muzabanah means buying dates on the tops of the palm trees and Muhaqalah means leasing out land."

وَحَدَّثَنِى أَبُو الطَّاهِرِ أَخْبَرَنَا ابْنُ وَهْبٍ أَخْبَرَنِى مَالِكُ بْنُ أَنَسٍ عَنْ دَاوُدَ بْنِ الْحُصَيْنِ أَنَّ أَبَا سُفْيَانَ مَوْلَى ابْنِ أَبِى أَحْمَدَ أَخْبَرَهُ أَنَّهُ سَمِعَ أَبَا سَعِيدٍ الْخُدْرِىَّ يَقُولُ نَهَى رَسُولُ اللَّهِ -صلى الله عليه وسلم- عَنِ الْمُزَابَنَةِ وَالْمُحَاقَلَةِ. وَالْمُزَابَنَةُ اشْتِرَاءُ الثَّمَرِ فِى رُءُوسِ النَّخْلِ. وَالْمُحَاقَلَةُ كِرَاءُ الأَرْضِ.

It was narrated from Nafi' that Ibn 'Umar used to lease out his farmland at the time of the Prophet (s.a.w) and during the leadership of Abu Bakr, 'Umar and 'Uthman, and the beginning of the leadership of Mu'awiyah. Until, at the end of the leadership of Mu'awiyah, he heard that Rafi' bin Khadij narrated a Hadith in which (he mentioned) it was forbidden by the Prophet (s.a.w). He entered upon him, when I was with him, and asked him. He said: "The Messenger of Allah (s.a.w) forbade leasing out farmland." Then Ibn 'Umar stopped doing that.When he was asked about that afterwards he said: "Rafi' bin Khadij said that the Messenger of Allah (s.a.w) forbade it."

وَحَدَّثَنَا يَحْيَى بْنُ يَحْيَى أَخْبَرَنَا يَزِيدُ بْنُ زُرَيْعٍ عَنْ أَيُّوبَ عَنْ نَافِعٍ أَنَّ ابْنَ عُمَرَ كَانَ يُكْرِى مَزَارِعَهُ عَلَى عَهْدِ رَسُولِ اللَّهِ -صلى الله عليه وسلم- وَفِى إِمَارَةِ أَبِى بَكْرٍ وَعُمَرَ وَعُثْمَانَ وَصَدْرًا مِنْ خِلاَفَةِ مُعَاوِيَةَ حَتَّى بَلَغَهُ فِى آخِرِ خِلاَفَةِ مُعَاوِيَةَ أَنَّ رَافِعَ بْنَ خَدِيجٍ يُحَدِّثُ فِيهَا بِنَهْىٍ عَنِ النَّبِىِّ -صلى الله عليه وسلم- فَدَخَلَ عَلَيْهِ وَأَنَا مَعَهُ فَسَأَلَهُ فَقَالَ كَانَ رَسُولُ اللَّهِ -صلى الله عليه وسلم- يَنْهَى عَنْ كِرَاءِ الْمَزَارِعِ. فَتَرَكَهَا ابْنُ عُمَرَ بَعْدُ. وَكَانَ إِذَا سُئِلَ عَنْهَا بَعْدُ قَالَ زَعَمَ رَافِعُ بْنُ خَدِيجٍ أَنَّ رَسُولَ اللَّهِ -صلى الله عليه وسلم- نَهَى عَنْهَا.

It was narrated that Nafi' said: "I went with Ibn 'Umar to Rafi' bin Khadij in Al-Balat, and he told him that the Messenger of Allah (s.a.w) forbade leasing out farmland."

وَحَدَّثَنَا ابْنُ نُمَيْرٍ حَدَّثَنَا أَبِى حَدَّثَنَا عُبَيْدُ اللَّهِ عَنْ نَافِعٍ قَالَ ذَهَبْتُ مَعَ ابْنِ عُمَرَ إِلَى رَافِعِ بْنِ خَدِيجٍ حَتَّى أَتَاهُ بِالْبَلاَطِ فَأَخْبَرَهُ أَنَّ رَسُولَ اللَّهِ -صلى الله عليه وسلم- نَهَى عَنْ كِرَاءِ الْمَزَارِعِ.

It was narrated from Nafi' that Ibn 'Umar used to rent out land. Then he was told a Hadith from Rafi' bin Khadij. He said to him: "Come with me," and we went to him, and he narrated from some of his paternal uncles and said that the Prophet (s.a.w) had forbidden leasing out land. Then Ibn 'Umar stopped doing that and he did not rent it out.

حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى حَدَّثَنَا حُسَيْنٌ-يَعْنِى ابْنَ حَسَنِ بْنِ يَسَارٍ-حَدَّثَنَا ابْنُ عَوْنٍ عَنْ نَافِعٍ أَنَّ ابْنَ عُمَرَ كَانَ يَأْجُرُ الأَرْضَ - قَالَ - فَنُبِّئَ حَدِيثًا عَنْ رَافِعِ بْنِ خَدِيجٍ-قَالَ-فَانْطَلَقَ بِى مَعَهُ إِلَيْهِ -قَالَ-فَذَكَرَ عَنْ بَعْضِ عُمُومَتِهِ ذَكَرَ فِيهِ عَنِ النَّبِىِّ-صلى الله عليه وسلم-أَنَّهُ نَهَى عَنْ كِرَاءِ الأَرْضِ. قَالَ فَتَرَكَهُ ابْنُ عُمَرَ فَلَمْ يَأْجُرْهُ.
